1. Acceptance of Terms
By accessing or using the MotorsMatrix platform (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service.
These Terms apply to all users, including public visitors, registered buyers, and dealer accounts. Additional terms may apply to dealer subscriptions as set out in Section 4.
We reserve the right to update these Terms at any time. We will notify registered users by email. Continued use after changes take effect constitutes acceptance.
2. Accounts and Eligibility
To access certain features you must register an account. You agree to:
- Provide accurate and complete information during registration.
- Keep your credentials confidential and not share your password.
- Notify us immediately of any unauthorised use of your account.
- Be at least 18 years of age, or the age of majority in your jurisdiction.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in harmful behaviour.
3. Vehicle Listings and Content
3.1 Dealer Listings
Dealers are responsible for the accuracy and legality of all listings they publish. By posting a listing, you represent that:
- You have the right to sell or offer the vehicle.
- All stated information (price, mileage, condition, history) is accurate to the best of your knowledge.
- The vehicle is not subject to any undisclosed liens or legal restrictions.
- All images are of the actual vehicle or accurately represent it.
3.2 "Sell My Car" Submissions
Public users may submit vehicles via the "Sell My Car" feature. Submissions are private enquiries sent to registered dealers, not active marketplace listings. You confirm that submissions are accurate and that you own or are authorised to sell the vehicle.
3.3 Prohibited Content
You may not post content that is fraudulent, misleading, related to stolen or undisclosed salvaged/written-off vehicles, in violation of applicable law, spam or duplicate listings, or offensive and harmful to other users.
⚠ Disclaimer: MotorsMatrix is a platform that connects buyers and dealers. We do not verify listing accuracy, conduct vehicle inspections, or guarantee the condition or title of any vehicle. Buyers should conduct their own due diligence before purchasing.
4. Dealer Subscriptions and Billing
4.1 Plans and Fees
- Professional — R5,500/month — up to 50 active listings.
- Elite Multi-Lot — R8,500/month — up to 150 active listings.
- Enterprise Group — Custom pricing — unlimited listings.
4.2 Listing Limits
Active listing counts are enforced automatically. Attempting to publish listings beyond your plan limit will be rejected. Upgrading your plan immediately increases your allowance.
4.3 Payment and Invoicing
Subscription fees are invoiced monthly. Failure to pay within 30 days may result in account suspension. All prices are in Namibian Dollars (NAD) and exclusive of VAT where applicable.
4.4 Cancellation
Dealers may cancel their subscription at any time by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
5. Prohibited Uses
You agree not to:
- Scrape, crawl, or systematically extract data from the platform without written permission.
- Use automated tools to submit enquiries, generate fake leads, or manipulate analytics.
- Attempt to access accounts, systems, or data not belonging to you.
- Introduce malware, viruses, or other harmful code.
- Use the platform to facilitate money laundering, fraud, or other illegal activities.
- Harass, threaten, or abuse other users or MotorsMatrix staff.
- Reproduce or commercially exploit platform content without permission.
- Impersonate another person or entity.
Violations may result in immediate account termination and, where appropriate, reporting to law enforcement.
6. Intellectual Property
The MotorsMatrix platform, including its design, software, trademarks, and original content, is owned by MotorsMatrix (Pty) Ltd and protected by applicable intellectual property laws.
By posting content (vehicle listings, photos, descriptions) you grant MotorsMatrix a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute that content in connection with operating and promoting the platform. You retain ownership of your content.
You may not use MotorsMatrix trademarks, logos, or branding without prior written consent.
7. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
MotorsMatrix does not warrant that the Service will be uninterrupted or error-free, that listing information provided by dealers or users is accurate, or that transactions will be completed successfully.
To the fullest extent permitted by law, MotorsMatrix (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.
8. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Namibia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Namibia.
